Draft bill on the Highway Code: Clarifications from the Ministry of the Interior

On Monday, the Ministry of the Interior, Local Authorities, and Transport stated that the draft bill on the Highway Code, which private transport operators strongly contested, is a tool designed to correct dangerous behaviour.

The road safety bill forms part of a comprehensive revision of public policy, developed in response to the alarming increase in traffic accidents. Drafted through in-depth intersectoral cooperation involving security services, the justice system and other relevant institutions, the bill aims to address the situation more effectively. The Council of the Nation is expected to review the text and express concerns about certain controversial provisions, which could lead to the formation of a joint committee comprising government and parliamentary representatives to refine the law content in accordance with constitutional provisions.

This joint committee would be responsible for revising the disputed provisions based on hearings with government officials, parliamentarians and experts before submitting a revised text to both chambers for final approval. The authorities emphasise that road safety is a comprehensive policy grounded in education, awareness-raising, training and deterrence; the latter is merely a tool to correct dangerous behaviour. The sanctions provided for are graduated and apply only to drivers who are clearly identified by law as being in violation.

Comprising 190 articles, the bill is not limited to punitive measures; it also regulates traffic rules, driving licence requirements, professional driving and vehicle technical standards. It rejects the notion of automatic driver liability in the event of a fatal accident, as each case is subject to a thorough investigation that considers "force majeure". The text also broadens legal responsibility to include all stakeholders involved in road safety, such as road maintenance authorities, driving schools, and technical inspection centres. Finally, it strengthens user protection by penalising uncivil behaviour, addressing driver distraction, and clearly assigning responsibility to the state and local authorities for maintaining and ensuring compliance with road infrastructure.
