Private hire vehicle activity: the end of legal uncertainty

Already widespread in Algeria for several years, the activity of private hire vehicles provided via mobile apps will soon have a legal framework to regulate it.

The Minister of the Interior and Transport, Said Sayoud, announced from the National People's Assembly, where he was answering questions from MPs, that a bill to regulate the activity of private hire vehicles had been finalised.

"The bill for the regulation and supervision of transport via electronic applications is currently with the General Secretariat of the Government," revealed Said Sayoud, who considers it to be "very important.

The Minister of the Interior and Transport has promised to follow up "personally" with the General Secretariat of the Government to speed up this matter.

Although there is some legal uncertainty surrounding this activity, the Minister of the Interior and Transport has reassured private hire vehicle drivers. With the upcoming regularisation of this activity, drivers will be protected by a law governing their profession.

Said Sayoud was keen to clarify that private hire drivers were not "illegal in the strict sense" of the term. However, the fact remains that this regularisation of the activity should be welcomed with relief. Indeed, despite the legal existence of the electronic applications employing them, drivers did not have legal cover. Given the legal uncertainty, drivers were being fined during roadside checks. Over time, some of them asked their customers to sit next to them to avoid being fined during checks. With the regularisation of the activity, drivers will have a law to cover them and allow them to operate legally.

The end of legal uncertainty

Regularisation should also enable effective combat of the abuses observed in this activity. Harassment of female passengers and assaults on customers: numerous accounts from users and drivers are regularly reported, particularly on social media, sometimes accompanied by supporting videos.

In such cases, drivers and customers will have a legal basis to refer to in the event of a dispute.

At a professional level, the existence of a legal framework would pave the way for drivers to benefit from social security coverage and justify their activity with the tax authorities. For example, a driver who has no other job could benefit from being registered with the tax authorities, the CNAS and the Casnos and would be entitled to a pension at a later date. This is one of the advantages that could benefit private hire drivers.

The new bill should also put an end to the controversy between regular taxi drivers and private hire drivers. In recent years, the national taxi drivers' union has often denounced the proliferation of private hire vehicles, considering them to be illegal. From now on, each activity will have its own legal framework, which should facilitate the coexistence of private hire vehicles and taxi drivers on the ground.

Regularisation should also bring greater clarity, which could attract investors potentially interested in this activity.

The success story of the Yassir app, which began as a chauffeur-driven car service and quickly rose through the ranks, diversifying its services in Algeria and expanding into other international markets, could inspire other investors, encouraged by the existence of a legal framework.
