Revision of the law on the judiciary: the bill presented to the APN

On Sunday in Algiers, the Minister of Justice, Keeper of the Seals, Mr Lotfi Boudjemaa, stated that the revision of the organic law on the status of the judiciary, in accordance with the 2020 Constitution, “lays the foundations for a new phase for the judiciary in Algeria.”

The Minister of Justice has presented a reform of the law on the judiciary to bring it into line with the changes introduced by the 2020 Constitution. As the previous 2004 law had become outdated, the 110-article bill aims to modernise the judicial system, strengthen specialisation and improve the quality of justice.

The text expands the powers of the High Council for the Judiciary (CSM), which becomes responsible for all aspects of magistrates' careers: assignment to courts, promotion, continuing education and authorisations related to their duties. It also creates the position of assistant magistrate to support the high courts.

The reform seeks to guarantee the independence of magistrates through job security, a protective salary system and clear guidelines on transfers, leave and trade union rights. It prohibits any political or lucrative activity not related to teaching to avoid conflicts of interest.

The bill specifies disciplinary procedures, serious professional misconduct, suspension procedures and rules governing negligence, while ensuring respect for the rights of defence. It also defines a new pension system with the possibility of extending the magistrates' service, while emphasising continuing training to improve the efficiency of the judicial system.
